1. What is RERA?

RERA, or the Real Estate (Regulation and Development) Act of 2016, was passed to regulate the real estate industry. The RERA Act seeks to bring transparency and accountability to the real estate industry in order to protect home buyers’ interests and restore lost faith in the industry.

The Act creates the Real Estate Regulatory Authority (RERA) in each state to oversee the real estate industry. RERA also serves as an adjudicating body to ensure that disputes are resolved as quickly as possible.

2. When Can A Buyer File a Complaint Against A Builder?

A buyer may file a complaint with the RERA Authority if he or she believes that a builder, developer, promoter, or real estate agent has violated or contravened the provisions of the RERA Act. Any homebuyer who wishes to seek redress for their grievances may file an RERA complaint against the builder. If a home buyer encounters any of the following issues with the builder, they can file a complaint with RERA.

Delay in Possession:

If a builder fails to deliver possession of a property, the buyer may file a complaint against the builder to obtain immediate possession or a full refund plus interest.

False Advertisement:

If a buyer was misled by false advertisements and decided to deposit money with the promoter, a complaint can be filed against the developer, promoter, and even the endorsers.

Advance Payment:

A builder may request up to 10% of the total cost of the building, apartment, or plot as an advance payment. If a builder requests more than 10%, the buyer has the right to file a complaint.

Improper Project Registration:

It is mandatory that all projects be registered under RERA. If a builder sells or attempts to sell an unregistered project, the buyer has the right to file a complaint against the builder.

No project details:

All project details, including project plan, layout, and government approvals, must be updated on the RERA website. If a builder or developer violates this provision, a complaint may be filed.

Structural Defects:

If there are any structural defects in the workmanship and quality of the services, the promoter must compensate the allottee for the amount paid. If the buyer is not compensated, he or she may file a complaint.

Transfer of Ownership:

A promoter may not transfer majority ownership to a third party. If he or she is discovered transferring majority rights to a third party without the consent of the two-third majority of allottees, a complaint can be filed.

3. How To File a Complaint Under RERA?

Any dissatisfied homebuyer who falls under the purview of RERA may file a legal action against the developer or builder. The following depicts the documentary procedure for filing a complaint.

•The buyer’s information.
•The property’s registration number and address.
•A concise statement of the claim’s facts.
•If any, the reliefs and interim reliefs.

A complaint filed under RERA is governed by the simple civil procedure code concept of Territorial Jurisdiction (i.e., it must be filed before the adjudicating officer of the area where the project or apartment is located or where the cause of action arose).

4. How to File a RERA Complaint on the Telangana State Portal?

The procedure for filing a complaint against a builder under the RERA act is outlined below.

Step 1 – To register an RERA compliant, go to the Telangana RERA portal. A link to register a complaint can be found on the home page.

Step 2 – After clicking on the complaint registration link, you will be directed to a page where you must enter the specifics of your complaint.

Step 3 – On this page, enter your name, address, contact information, and complaint details. You have the option of attaching supporting documentation.

Step 4 – You must pay Rs.1000 to register your complaint. You can pay for Complaint Registration using your net-banking account.

Step 5: Accept the declaration and submit the complaint by clicking the submit button.
